2. Introduction
These Terms & Conditions govern your use of the Ibiza Leads website and services. By booking a Lead Leak Audit, purchasing our services, or otherwise engaging with us, you agree to be bound by these terms. If you do not agree, please do not use our services.
These terms apply to all clients, whether businesses (B2B) or consumers (B2C).
3. Services
Ibiza Leads provides done-for-you enquiry-to-sale systems for service businesses, primarily based in Ibiza.
What's included in our core service:
Conversion landing page and thank-you page
Online booking calendar
Enquiry capture forms
Centralised lead management (inbox and pipeline)
Automated acknowledgement and follow-up sequences (7-10 days)
WhatsApp integration
Alerts and notifications for new or stale enquiries
Full technical setup (domain, email routing, DNS)
Handover and training
What's NOT included:
Running ads or paying ad spend
Social media content creation
Replying to messages on your behalf
Ongoing marketing management
Full website rebuilds (unless separately agreed)
4. Pricing, Taxes and Payment
Setup fee: €2,500 (one-time)
Monthly retainer: from €97/month (covers platform, basic support, and WhatsApp integration)
VAT (IVA) treatment:
Clients based in Spain: prices exclude 21% Spanish IVA, which will be added to all invoices.
Clients based in the European Union (B2B with valid VAT number): subject to reverse charge under Article 196 of EU VAT Directive 2006/112/EC.
Clients based outside the EU: services are not subject to Spanish IVA under Article 69.2 of Spanish VAT Law (Ley 37/1992).
Payment terms:
Setup fee: 100% payable in advance before work begins.
Monthly retainer: invoiced monthly, starting upon system handover.
Accepted payment methods: bank transfer and other methods listed at the time of invoicing. All prices are quoted in Euros (EUR).
5. Lead Leak Audit
The Lead Leak Audit is a complimentary 20-minute consultation to assess your current enquiry flow and identify leakage points.
The audit is obligation-free.
No payment is required to book an audit.
The audit does not guarantee any specific outcome or revenue.
6. Client Responsibilities
To enable us to deliver our services, you agree to:
Provide timely access to all required accounts and platforms.
Provide necessary content, logos, brand assets, and business information.
Respond to requests for information or approvals within a reasonable timeframe.
Ensure you have the legal right to use any content, images, or materials you provide to us.
Comply with all applicable laws and regulations in connection with your business.
Delays caused by lack of access, information, or response on your part may extend our delivery timelines and we accept no liability for such delays.
7. Intellectual Property and Ownership
Upon full payment and handover, you retain full ownership of:
Landing pages and funnels built specifically for your business.
Workflows and automations configured for your business.
All custom content created for your business under this engagement.
We retain ownership of any pre-existing templates, frameworks, methodologies, or proprietary tools used in delivery. You receive a perpetual licence to use these as integrated into your delivered system.
We do not retain access to your systems after handover unless separately agreed for ongoing support.
8. Delivery Timeline
Our standard delivery timeline is 7-10 working days from receipt of full access and all required information. Timelines may vary based on project complexity and client responsiveness, and any indicative dates are estimates, not guarantees.
9. Refunds and Cancellations
Setup fee:
Non-refundable once work has commenced.
If you cancel before work begins, we will refund 100% of the setup fee within 14 days.
Monthly retainer:
Cancel anytime with 30 days' written notice.
No refunds for partial months.
Right of withdrawal (consumers only):
Under Spanish Law 3/2014 and EU Directive 2011/83/EU on Consumer Rights, consumers (not businesses) have the right to withdraw from a contract for services within 14 calendar days of acceptance, without giving any reason. To exercise this right, send a clear written statement to [email protected] before the 14-day period expires.
If you have expressly requested that we begin performance of the services during the withdrawal period, you acknowledge that you will lose your right of withdrawal once the service has been fully performed, and that you may be liable for the proportionate cost of services performed up to the point of withdrawal.
10. Limitation of Liability
Ibiza Leads provides systems to help you capture and follow up on enquiries. We make no warranty or guarantee in respect of:
Any specific number of leads, enquiries, or bookings.
Any revenue, sales, or commercial outcomes.
Results from any third-party marketing, advertising, or platforms.
To the maximum extent permitted by Spanish law, our total aggregate liability under or in connection with these Terms shall not exceed the fees actually paid by you for the specific service giving rise to the claim. We exclude liability for any indirect, incidental, consequential, or special damages, including loss of profits, business, data, or goodwill.
Nothing in these Terms limits or excludes liability for:
Death or personal injury caused by negligence.
Fraud or fraudulent misrepresentation.
Any other liability that cannot be limited or excluded under applicable law.
11. Confidentiality and Data Protection
We treat all client information as confidential and will not disclose it to third parties except:
As required to deliver our services (e.g. CRM platforms, hosting providers, integrations used in your system).
As required by law, court order, or competent regulatory authority.
Personal data is processed in accordance with our Privacy Policy [link to Privacy Policy] and the EU General Data Protection Regulation (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).
12. Force Majeure
Neither party shall be liable for any failure or delay in performance caused by events beyond reasonable control, including but not limited to natural disasters, internet outages, cyberattacks, governmental actions, strikes, or pandemics.
13. Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of Spain. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ibiza, Illes Balears, Spain.

14. Changes to These Terms
We may update these Terms & Conditions from time to time. The latest version will always be available on this page, with the "Last updated" date amended accordingly. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
